visa overstay problem advice

My 30 day visa ran out on the 5th December I was supposed to travel on the 4th to work in Abudhabi bet its was delayed for 2 days I spoke to Immigration in Jomtien and they said no problem pay 500 baht a day at airport so long as u leave within 20 days we wont arrest you , they cannot give me visa extension dont know why ????? i was very flakey with depression and a bad cold last week so things got put on hold

now my company has delayed my work until 17th although i am on contract , but several people have told me that suvarnabhumi immigration will demand 20,000 baht ??? not 500 a day

i was going to do a visa run to cambodia but have been told they will not let overstay out ???

what should I do , normally I have 1 yerar marriage visa but it lapsed in October when i was at work in Philippines and they insist I have tio renew in in UK ,

I have never been in this situation of overstay before and i cant get straight anwswer from immigration so I think they see an opportunity for a scam .

spoke to my thai doctor but he says that Hospital letter for overstay is only accepted for in patients .
 
1. Go talk to a recommended immigration lawyer, he might be a able to pull a medical extension through "relationships" he has


2. Another option would be to fly to say P.P, Cambodia, pay the overstay fine on the way out & get a 60 day (extendable by another 30 days) Thai tourist visa


3. There is a maximum overstay penalty of 20,000 Bht for up to one year overstay, as they told you, under 20 days overstay you won't be arrested, over 20 days the Police can arrest you.

You can pay the overstay fine at the airport and also at your local Immigration Office (guess Jomtien in your case). In your case the fine will be about 6000 Baht for 12 days. This is what ThaiVisa says about it:

You can easy clear an heavy overstay at the Airport, but if you are caught by Immigration before you reach the airport, you will be jailed and deported until you can pay your fine and show a one way ticket back to your home country.

If you overstay by one day, there is no charge. After that, it's 500B per day, so 2 days is a 1,000B fine, 3 days 1,500B etc…
Paying the fine is simple. When going through Immigration, they will notice the overstay and take you to a desk to pay it, taking about 5 minutes in all. Fines can also often by paid in advance at any Immigration bureau.

Or try Key Visa Company in Pattaya which also seems to know all the inns and outs on visa's and visa problems, etc. -

Darren, Key Visa, got me my Retirement after me having done over 2 years of in and out 28 days at a time..... all my passport had was pages and pages of Visa on Arrival. Go see him..... it'll be a HUGE weight off your shoulders. Don't forget to get a multiple re-entry with the Retirement visa. And it doesn't matter who you work for, the requisite is regular monthly income over their stipulated amount. Go see Darren this morning, you will probably get your passport back Saturday.

Great news on the work front, sounds just like what you need at the mo, hope it gives you another perspective and brings you out of your fug. And don't forget to ask 'em if they need a decent Camp Boss!

Hi Jerry, as already suggested here, get a retirement visa & make life simpler for yourself.

I would like to offer the following which may be of use for you- I believe it to be correct but things do change & also TIT !

Leave the country, get a 90 day Non Imm O to re-enter (stating for the purposes of seeking to retire and in your case multi entry) and stick 800k baht in a bank & forget about it, sooner the better as they require it in the bank 90 days before the next step.

In the last month of your 90, apply locally for an extension based on retirement. Present the bank book showing 800k has been in the account for +90 days, accompanied by a formal cert from the bank stating the same. Fill the form in, do the photo copies and pay 1,900 baht. You should get an extension for a year.

(Monthly income from outside the country is also acceptable but in my experience, its more hassle than its worth with additional red tape performance with employer, consulate etc. Just stick 800k aside & leave it there for the annual event.)

However, with this type of stamp in your passport, you need to be constantly aware of the need to apply for permission to re-enter on that multi entry Non Imm O. You do that either each time locally and pay another 1,900 each time or get a multiple one for +3k.

Each time you leave / return you need to ensure the clerk at the airport doesnt wipe out /canx your annual period by failing to recognise you have the vital re-entry permission. Just to reiterate, the Non Imm O may well be a multi entry but as you get your annual extension, you need to then get the permission to re-enter thingy too.

The multi re-entry permit is 3800 Baht - that is what I am using also (Retirement and a multi re-entry). Indeed as Ally says, check the stamps the immigration guys put in when you enter the country again. In August this year the immigration at Chiangkhong cancelled my Multi Re-Entry permit (put a big USED stamp on it) which I did not notice at that time. Three weeks later I saw it and went to Immigration here in Chiangmai to have it rectified but that was not possible as I should have done that immediately when I entered at Chiangkhong.

I had the same think happen a couple of years ago on the Friendship Bridge and have since learnt to check every stamp every officer adds to my passport everywhere!

I believe that 800,000 needs to be in the bank account for at least 3 months prior to applying for, and renewing, the Retirement Visa.
Furthermore, copies of the bank book and a signed letter from the bank is required.
No difficult and definitely worth getting the Retirement Visa.

Oh, on two occasions at CM Immigration, despite quite clearly requesting a Multiple Entry Visa, I was granted a Single Entry!
It seems that part of the deal needs to be very clearly established with the good officers of CM Immigration.

he cant sort the overstay before I leave on Monday a pattaya jomtien immigration is overloaded at the moment massive delays and it would probably cost me more than airport fines so told me to sort it at airport, he quoted me 41,000 Baht to sort out a retirement visa , i could do it myself if I was here for a month or so curently taking about 3 weeks if all paperwork in order , but did admit that retirement visa is probably not the best option for me as I travel so often and at short notice and the re=entry permit rule would be a major bureaucratic nusiance , best to get another Marriage B visa in UK for now , lasts one year cost 5000 baht 90 days each time and no re-entry permit nonsense . thats what i have used for last 8 years
 
With the retirement visa you only need to get the multiple re entry permit once (B1,900) and it is good for the whole year. No hassle and leave as many times as you want, get 90 days each entry and if you always leave again before the 90 days is up, as you will if you travel a lot , then you never have to do the 90 report at immigration as that clock resets each time you leave/enter. Same as Non "o" , Non "B" etc except if you want to stay longer than 90 days you can with the retirement visa without leaving, only do the 90 day report and stay in country.

If your going for another Non imm based on marriage, it would be far cheaper to fly into Malaysia, either the Thai Embassy in KL or their Consulate in Kota Bharu. I got mine in KB last year I think 5000 baht and done over night. The only hic-cup was the letter from the British Consulate in Pattaya regarding my income, at the bottom of their letter it stated they can not guarantee the accuracy of the proof of income, which caused the Consulte in KB to request further evidence. Fortunately I had a Thai bank book with me and that was enough for them to grant the visa. I took, yellow house book, copies of my wife's id, our marriage certificate, a photo of the two of us, a hand written letter from her basically saying I come home every 6 weeks for 6 weeks, and proof or unproof of income. There is no requirement to have 400,000 in the bank, just need to prove you bring a minimum of 40,000 in each month.

I need to re-new mine again in the new and will use KB Consulate again, due to working near by.
 
after i finish my next contract in Abudhabi i will be going to Uk for an operation so will have time to do marriage visa agian there, marriage visa does not require re-entry permit which can be a real problem at times from previous experience ,
 
Well it al went smooth at Suvarnabhumi 12 days overstay 6000 baaht 5 minutes delay and all the worry over
